By the 1980’s, defendants in medical malpractice cases were routinely insisting on confidentiality of the terms of any settlement, especially the amount paid to settle the patient’s claim. While this was ordinarily restricted to medical malpractice cases for the most part in the 1980’s, the practice grew in later years to include most settlements in any case where the amount was in the hundreds of thousands of dollars or more.

There are exceptions to the above, however. Class action settlements and other settlements that require court approval are unlikely to be kept confidential. Furthermore, verdicts after a trial cannot be made confidential because most trials are open to the public and may even be covered by local or national media.

Consequently, even though we have settled numerous cases for well over one million dollars, we are prevented from identifying our clients, the defendants or otherwise describing the circumstances under which such settlements were paid in a particular case because of the confidentiality clauses defendants have insisted on including as a condition of settlement. Accordingly, it is seldom the case that a large settlement can be individually publicized if it occurred in the last 25 years. Nevertheless, there are exceptions to nearly every rule...
