AMPUTEE WINS $200,000 IN SETTLEMENT OVER CRASH

DAVENPORT, IA - A settlement was reached here Wednesday that will pay $200,000 to a Lisbon man whose leg was amputated as a result of a 1979 motorcycle crash near Tipton.

Under the out-of-court agreement, the cyclist, James Cubbage, 36, will receive $100,000 from Cedar County and Alpha Crushed Stone Inc. of Marion, said Tom Riley of Cedar Rapids, Cubbage's attorney. A half-dozen truck drivers working for the company will pay another $100,000, Riley said.

Cubbage was seriously injured early on the morning of September 20, 1979, when his motorcycle struck gravel that accidentally had been spilled on a paved Cedar County road, Riley said. Truckers had been hauling gravel from a nearby Alpha quarry, and Riley contended in court that the gravel spilled because drivers intentionally were overloading their rigs to save time.

The settlement was worked out before the case went to the Scott County District Court jury. The case was moved to Davenport from Cedar County because the county was a defendant.
